Robin is a “transactions lawyer”. She regularly negotiates, drafts and reviews the different agreements necessary for businesses in various fields, e.g., retailing, consumer goods, manufacturing and sales, tech development, artist/writer collaborations, fine arts, and the agreements especially needed to secure/protect intellectual property rights, and create, produce and place/distribute commercial messages and conduct promotions.
Robin is also a certified commercial arbitrator. She has counseled and arbitrated matters involving Leading National Advertisers, Leading Advertising Agencies, as well as smaller businesses. Together with her NAD casework, she has served as an ADR neutral on approximately 200 advertising, entertainment, and intellectual property disputes.
Robin is an active member of the New York City Bar Association. She is currently a member of the Small Law Firm Committee and Consumer Affairs Committee, and has served in the past on the Arbitration Committee and Art Law Committee. She is also a member of the New York State Bar Association (Intellectual Property Committee), and has lectured and written articles on advertising, promotion and alternative dispute resolution, and ethical rules applicable to attorney advertising.
Robin established her law firm 2004. Prior to that Robin was Senior VP, General Counsel (Advertising and Marketing) of Bates Advertising USA, Associate General Counsel of Group Danone’s US divisions (including The Dannon Company), Senior Counsel of the National Advertising Division of the National BBB Programs, Inc. (NAD), and VP, Assistant General Counsel of Ted Bates Worldwide.

Commercial speech enjoys First Amendment protection; but it’s not the same as the protection enjoyed by political speech, religious speech, artistic expression, opinion, etc.
Commercial speech protection exists only if it involves legal activity, and it is “truthful and not misleading”. But what it means to be “truthful and not misleading” changes, and today it is heavily regulated on federal, state, and even local levels. There are many convoluted federal and state statutes and regulations impacting the creation, production, and placement of all commercial messages and promotion implementation. This is particularly affected by a media landscape constantly in flux. Therefore, when advertising and promotion or B2B or B2C commerce involves any device, the same industry and advertising laws will still apply, but so will an additional set of rules and issues to address in contracts.
